What Are Stamp Duty and Registration Charges?
Stamp duty is a state tax paid to the Karnataka government on the transfer of property. It is what gives a sale deed legal validity as evidence in court. Registration charges are a separate fee paid to the Sub-Registrar's office for entering the transaction in the official records under the Registration Act, 1908.
Both are paid in addition to the price you agree with the seller or builder. They are also separate from GST, if applicable on an under-construction property, and from any maintenance deposit or corpus fund demanded by the builder.
How Are the Charges Calculated?
In Karnataka, stamp duty is generally levied as a percentage of the higher of the sale consideration in the agreement and the guidance value (the government-notified minimum value) of the property. Registration fee is also a percentage of the property value and is much lower than stamp duty. In addition, a cess or surcharge may apply depending on the location of the property.
The stamp duty percentage has in the past been structured in slabs linked to the property value, with lower rates for lower-priced homes. Because slabs and rates have changed over the years, do not rely on a figure quoted by an agent or a forwarded message. Check the current schedule on the official Kaveri portal of the Department of Stamps and Registration before you finalise your budget.
Guidance Value vs Market Value
Guidance value is set by the government for each area and property type and is revised periodically. If you buy below guidance value on paper, duty is still charged on the guidance value. Paying part of the price in cash to show a lower value on the deed is illegal, exposes both parties to penalties, and leaves you with weak proof of ownership and no valid claim for the amount paid.
Insist that the full consideration is recorded in the agreement and paid through banking channels so that your payment trail matches your documents.
Step-by-Step: Paying and Registering
First, the agreement to sell or sale deed is drafted and the duty is computed on the property value. Second, stamp duty and registration fee are paid, commonly through the online Kaveri system or authorised e-stamping channels. Third, both parties, along with witnesses, appear before the Sub-Registrar with identity and address proofs and the required documents for biometric and photo verification. Fourth, after registration, collect the registered deed and complete the khata transfer and other mutation steps.
For an under-construction flat, registration of the sale deed usually happens at or near possession, while the agreement for sale under RERA may also attract duty. Check which instruments are being stamped and when, and keep every receipt.
Common Mistakes to Avoid
Do not assume that the builder's quoted 'registration charges' match the official figure, ask for the working and compare it with the portal. Do not skip checking the guidance value for your exact locality. Do not pay duty on a property whose title, RERA registration or approvals you have not yet verified. And do not leave registration pending after full payment, as an unregistered transaction does not give you clear legal title.
