What Are OC and CC?
The Completion Certificate is issued by the local planning authority (in Bengaluru, typically BBMP or BDA depending on the area; elsewhere the relevant city corporation or development authority) after the builder reports that construction is complete and an inspection finds it broadly in line with the sanctioned plan. The Occupancy Certificate certifies that the building is fit for occupation, with essential services such as water, sanitation, electricity and fire safety in place.
Note that the abbreviation "CC" is also commonly used for the Commencement Certificate, the permission to begin construction. Always check which document you are being shown, and ask for both the commencement and the completion/occupancy documents.
Why They Matter to You as a Buyer
Without an OC, a building is technically not authorised for occupation. Practical consequences can include difficulty obtaining permanent electricity and water connections, reluctance of banks to finance resale of the flat, and exposure to action by the authority for unauthorised occupation or deviations.
Under the Real Estate (Regulation and Development) Act, 2016, a promoter is required to hand over possession along with the documents and plans of the project, and the agreement for sale is expected to reflect the date by which possession will be given. Section 11 also places obligations on the promoter regarding the occupancy or completion certificate and handing over of common areas to the association of allottees. Read the Act and the Karnataka RERA rules for the exact wording.
Partial vs Full OC and Deviations
In large projects with several towers, authorities may grant occupancy for completed towers while others are still under construction. Ask which tower and which floors your OC covers. A partial OC does not automatically cover your unit.
Check that the built area, number of floors and amenities match the sanctioned plan. Deviations such as extra floors or altered setbacks can prevent the OC from being issued or can lead to penalties. Compare the plan attached to your agreement with the sanctioned plan available from the authority.
How to Verify OC and CC Before Taking Possession
Ask the builder for a copy of the OC and CC and confirm their authenticity directly with the issuing authority rather than relying only on the copy provided. Note the certificate number, date of issue, the survey number and the name of the project. Confirm that these match your sale agreement and the RERA registration of the project on rera.karnataka.gov.in.
Also ask for the fire clearance, lift licence, and No Objection Certificates relevant to the building, since the OC process often depends on them. If the OC is not yet issued, do not agree to complete the final payment or accept keys without taking legal advice, and keep written records of all communication with the builder.
What To Do If the Builder Has No OC
Raise the issue in writing with the builder and request a timeline. If possession is being delayed or the promoter fails to meet obligations, you may be able to file a complaint with Karnataka RERA. Document everything: payment receipts, the agreement, and correspondence. A property lawyer can advise on remedies specific to your situation.
